En este trabajo pretendemos dar cuenta de cómo los criterios de delimitación entre el conocimiento animal y el conocimiento humano en la epistemología contemporánea no son adecuados para agotar la complejidad epistemológica del fenómeno. Buscamos, así, establecer una tercera vía de interpretación, proponiendo una taxonomía de niveles que satisfaga las necesidades de clasificación del conocimiento animal sin dejar de lado la particularidad propia del conocimiento humano, a saber, la reflexividad. De esta manera, se pretende reinterpretar cómo ha sido concebido el (...) conocimiento animal en la epistemología contemporánea para reconstruir, a partir de las posturas mencionadas, una vía alternativa que dé cuenta, adecuadamente, de las particularidades del conocimiento animal en relación con el conocimiento humano. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

It is commonly accepted that Han Fei studied under Xunzi sometime during the late third century BCE. However, there is surprisingly little dedicated to the in-depth study of the relationship between Xunzi’s ideas and one of his best-known followers. In this essay I argue that Han Fei’s notion of xing, commonly translated as human nature, was not only influenced by Xunzi but also that it is an important feature of his political philosophy.

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

Teacher quality, its effect on students’ outcomes, and the association of these with economic growth, is the core of recent discussions in Latin America given the region’s weak results in international learning assessments. This paper investigates whether there is an effect of philosophy on the outcomes of critical reading for students in B.Ed. programs in Colombia. Relying on exact matching combined with propensity score matching with regression adjustment, we use national data from Colombia to show that students in B.Ed. in (...) philosophy outperformed students in other B.Ed. in critical reading test (0.401–0.124 SD), and, importantly, with higher effects observed for students with lower prior academic achievement (0.44 SD). This suggests that philosophy can help to narrow educational outcomes of students whose socioeconomic conditions are disadvantageous, contributing to social justice in education. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. En el presente texto se defenderá la idea según la cual, la filosofía y el filosofar están intrínsecamente ligados. Se partirá de un caso paradigmático, el caso de la filosofía analítica. A partir de su definición,se pretenderá mostrar que las características más sobresalientes de dicha corriente están fundamentalmente ligadas al acto de filosofar.Por medio de dicho ejemplo, se desea mostrar que enseñar la filosofía consiste en enseñar a filosofar, y que por lo tanto una no puede ser separada de la (...) otra. Aprender a filosofar es entonces, aprender a ver un problema detrás de cada página de un texto filosófico, una argumentación detrás de cada problema y finalmente, una verdad detrás de cada argumentación. Mackie, la consistance du théisme face au problème du mal. Cependant, nous refuserons de suivre la métaphysique modale adoptée par Alvin Plantinga et proposerons une position actualiste, et plus précisément l’essentialisme sérieux prôné par E. J. Lowe. This paper presents an impact evaluation of the policies for teacher education programs within the framework of the National Development Plan 2014-2018. The programs were compelled to obtain high-quality accreditation, increase the credits in school practices, and the English level, among other requirements. Relying on multivariable regression, it shows that, for the year 2021, there is no association between high-quality accreditation in most modules of the Saber Pro tests, or it is negative in the global score and quantitative reasoning. In (...) a second step, using Differences–in–Differences, it evidences how the changes made by the programs had positive effects on the performance of students compared to other professional programs. The results show significant improvement in most modules of the Saber Pro test, except for the English module. The effects were homogeneous by characteristics of the students and institutions, but heterogeneous by area of knowledge, indicating that the effect is mainly due to the curricular changes of the programs. Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

This article covers the different stages of the constitution of the person that goes beyond selfishness and self-affirmation and is formed as the inseparable unity of the metaphysical subject that is expressed in the "Other-in-the same" and "Being-for-the-other". This leads one to say that the person is intrinsically relation and exteriority that is realized in the language that transcends the inner self. This relationship, considered internally as a footprint, and in the exterior as visage, invokes a third party that establishes (...) and holds it. A modified visual search task demonstrates that humans are very good at resuming a search after it has been momentarily interrupted. This is shown by exceptionally rapid response time to a display that reappears after a brief interruption, even when an entirely different visual display is seen during the interruption and two different visual searches are performed simultaneously. This rapid resumption depends on the stability of the visual scene and is not due to display or response anticipations. These results are (...) consistent with the existence of an iterative hypothesis-testing mechanism that compares information stored in short-term memory (the perceptual hypothesis) with information about the display (the sensory pattern). In this view, rapid resumption occurs because a hypothesis based on a previous glance of the scene can be tested very rapidly in a subsequent glance, given that the initial hypothesis-generation step has already been performed. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. In a number of papers, Kit Fine introduced a theory of embodiment which distinguishes between rigid and variable embodiments, and has been successfully applied to clarify the ontological nature of entities whose parts may or may not vary in time. In particular, he has applied this theory to describe a process such as the erosion of a cliff, which would be a variable embodiment whose manifestations are the different states of erosion of the cliff. We find this theory very powerful, (...) and especially appropriate to capture the intuition that the same process may go on at different times. However, its formal principles have been subject to some criticisms, mainly concerning the mereological structure of a variable embodiment. Moreover, since the notion of variable embodiment is very general, simply saying that processes are variable embodiments is not enough to understand their ontological nature. To address these concerns, in this paper we proceed in two phases: first, we propose a revised version of Fine’s original theory adapted to the case of processes, which adopts a classical mereology instead of Fine’s hylomorphic mereology, and a temporalized constitution relation in place of Fine’s function of variable embodiment; second, we go deeper into the ontological nature of processes by revisiting the notions of homogeneity, intentionality, and telicity discussed in the literature, and propose an account based on ontological principles and not on semantic properties of predicates. This allows us to organize processes into a novel taxonomy based exclusively on their unity and individuation principles. (shrink)

Many think that expressivists have a special problem with negation. I disagree. For if there is a problem with negation, I argue, it is a problem shared by those who accept some plausible claims about the nature of intentionality. Whether there is any special problem for expressivists turns, I will argue, on whether facts about what truth-conditions beliefs have can explain facts about basic inferential relations among those beliefs. And I will suggest that the answer to this last question is, (...) on most plausible attempts at solving the problem of intentionality, ‘no’. (shrink)

What would happen if one morning you wake up clumsy, as if your sense of touch were unreliable, arbitrarily on and off? And what would this clumsiness look like if we could transfer it to the moral sense? The article expounds an interesting analogy between the sense of touch, loosely construed, and the moral sense: just as a sort of consistency is necessary for the sense of touch to do its job, so it is for the moral sense to play (...) its part. Touch enables us to navigate the everyday world of coffee pots and staircases; our moral sensibility comes into play when we act or when we judge our actions and those of others, and plays a directive role in what we feel, how we feel it, and how we react to it. Taking the analogy further, I will suggest that inconsistency causes, in both cases, a certain clumsiness, and that clumsiness is linked to arbitrariness – like the person that helps others in dire need, but only does so on some rainy days. This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. I argue that, once (...) we unpack the internal relation between directed duties, moral status, and flourishing, relations can ground personhood and include nonhuman animals. (shrink)

Drawing on behavioral economics, nudges (policy interventions based on choice architecture) have the capacity to strategically shape policymaking, subtly guiding individual behavior by adjusting their decision environment. Applied to enhance vaccinations, boost retirement savings, or promote healthy habits, these interventions align with consensus-defined well-being. As governments adopt nudges, scholars have explored their role in fostering virtues. This paper argues that nudges have the potential to efficiently contribute to virtuous development by instilling and sustaining habits, respecting individual choice, and ensuring deliberation. (...) La renta básica se nos presenta en la obra de Philippe van Parijs como una propuesta política filosóficamente argumentada, de modo tal que convencerá tanto al teórico de la justicia como al ciudadano que votará su implantación. En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. Proponents of enactivism should be interested in exploring what notion of action best captures the type of action-perception link that the view proposes, such that it covers all the aspects in which our doings constitute and are constituted by our perceiving. This article proposes and defends the thesis that the notion of sensorimotor dependencies is insufficient to account for the reality of human perception, and that the central enactive notion should be that of perceptual practices. Sensorimotor enactivism is insufficient because (...) it has no traction on socially dependent perceptions, which are essential to the role and significance of perception in our lives. Since the social dimension is a central desideratum in a theory of human perception, enactivism needs a notion that accounts for such an aspect. This article sketches the main features of the Wittgenstein-inspired notion of perceptual practices as the central notion to understand perception. Perception, I claim, is properly understood as woven into a type of social practices that includes food, dance, dress, music, etc. More specifically, perceptual practices are the enactment of culturally structured, normatively rich techniques of commerce of meaningful multi- and inter-modal perceptible material. I argue that perceptual practices explain three central features of socially dependent perception: attentional focus, aspects’ saliency, and modal-specific harmony-like relations. (shrink)

Los sociobiólogos han defendido una posición "calvinista" que se resume en la siguiente fórmula: si la selección natural explica las actitudes morales, no hay altruismo genuino en la moral; si la moral es altruista, entonces la selección natural no puede explicarla. En este ensayo desenmascaro los presupuestos erróneos de esta posición y defiendo que el altruismo como equidad no es incompatible con la selección natural. Rechazo una concepción hobbesiana de la moral, pero sugiero su empleo en la interpretación de la (...) psicología de los primates no humanos y en un modelo de progresión evolutiva que habría llevado a la moralidad como adaptación pasando por la razón instrumental. /// Sociobiologists have endorsed a "Calvinist" position captured in the following formula: if natural selection explains moral attitudes, morality is not genuinely altruistic; if morality is altruistic, then natural selection cannot explain it. I expose the false presuppositions behind this claim and argüe that altruism as fairness is not incompatible with natural selection. I reject a Hobbesian view of morality as an instrumental endorsement of fairness norms, but suggest its use to interpret primate psychology and to model an evolutionary progression ending in moral capacities as adaptations. Since the concept of “nudge” was introduced in 2008 by Thaler and Sunstein, proposing that small interventions based on changes in choice architectures can alter people’s behavior and make it easier for them to achieve their desired goals, the application in public policy of behavioral economics has gained significant attention. This has led to the emergence of different types of policies based on behavioral insights, which have been used in a variety of areas, including health or finance, with the goal (...) of promoting well-being and addressing social and economic issues. After providing a basic theoretical background as a frame of reference to understand gender violence, this study explores the use of tools from the field of behavioral economics as it is applied in public policy. Regulatory (paternalistic) and non-regulatory (libertarian) interventions based on behavioral insights will be considered: nudges, boosts, shoves, budges, or sludge audits, are examined as potential interventions to use in matters related to this type of violence. After evaluating these behavioral policy instruments and their potential effectiveness, the limitations of the behavioral perspective are recognized, and the need for a multifaceted approach to combating gender violence is acknowledged. The article concludes by arguing that public policies addressing gender violence should not only utilize behavioral tools but should also incorporate strategies related to education, legislation, and social norms. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. I argue that Husserl’s concept of position-taking, Stellungnahme, is adequate to understand the idea of second nature as an issue of philosophical anthropology. I claim that the methodological focus must be the living subject that acts and lives among others, and that the notion of second nature must respond to precisely this fundamental active character of subjectivity. The appropriate concept should satisfy two additional desiderata. First, it should be able to develop alongside the biological, psychological, and social individual development. Second, (...) it should be able to underlie the vast diversity of human beings within and across communities. As possible candidates, I contrast position-taking with two types of habit-like concepts: instinct and habitus, on the one hand, and customary habits, on the other. I argue that position-taking represents the active aspect of the subject while the habit-like concepts are passive. A subject’s position-takings and ensuing comportments are tied together by motivations, which evince a certain consistency, and for this reason are expression of the subject’s identity. I conclude by nuancing the relation between Stellungnahme and passivity. Passivity is deemed necessary to action but subservient to it; position-taking is thought to be prior to passivity. (shrink)

This work articulates two thesis: one Socratic and one Platonic; and displays how the first one is heir of the second. The Socratic one is called the principle of priority of definition; the Platonic one is the Recollection theory. The articulation between both theses is possible due to the Meno’s paradox, which makes a criticism on the first thesis, but it is solved with the second one. The consequence of this articulation is a new interpretation of the Recollection theory, as (...) a theory of knowledge acquisition that depends, mainly, on a distinction between knowledge and true opinion. To conclude, a new interpretation of the knowledge/true opinion distinction is displayed –not in the traditional fashion, evaluating the propositions one by one, and in an atomic way–, but as big blocks or chains of propositions shaping knowledge through explanatory reasoning (aitías logismós). This article faces the classic problem of the interpretation of what Aristotle calls in de An. III, 5 “the intellect that produces all things”, which is commonly named agent intellect. Historically, there have been two approaches: one that goes back to Alexander of Aphrodisias, who associates the agent intellect with the unmoved mover and the divinity, and another one, associated with Theophrastus but whose major representatives are Philoponus and St. Thomas of Aquinas, who consider that agent intellect is an exclusively (...) human faculty. This last interpretation has been the most accepted historically. Nevertheless, in recent years there has been a resurgence of interpretations of the agent intellect as divine (Caston, Frede, Burnyeat, and others). What we want to demonstrate in this article is that this revival, more than responding to a reinterpretation of the agent intellect, is due to a different understanding of the divinity in Aristotle’s philosophy, which supposes immanent characteristics closer to the human intellect. Desde que en 2008 se introdujera el concepto de nudge en el libro Nudge, que argumentaba que las pequeñas intervenciones basadas en cambios en la arquitectura de elección pueden alterar el comportamiento de las personas y facilitarles el logro de sus objetivos deseados, el uso de la economía del comportamiento en políticas públicas ha crecido significativamente, lo que ha llevado a la aparición de diferentes intervenciones basadas en conocimientos conductuales. Estas intervenciones se han aplicado en distintas áreas de políticas públicas (...) y administrativas, incluyendo salud, finanzas, o medio ambiente, con el objetivo de promover el bienestar y abordar problemas sociales y económicos. El uso de estas aplicaciones en cuestiones relacionadas con la violencia de género ha sido con frecuencia ignorado. De este modo, el objetivo de este estudio es analizar el uso de herramientas de la economía del comportamiento en políticas públicas, como nudges, boosts o auditoría de sludges y su aplicación a asuntos relacionados con este tipo de violencia. Al mismo tiempo que se señalan los posibles beneficios de su uso, también se reconocen las limitaciones del enfoque conductual, apuntando a la necesidad de una aproximación multifacética para combatir dicha violencia. The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. In particular, I focus on single-event virtues, first-time virtuous acts, and morally dangerous situations. (shrink)

Most people agree that inflicting unnecessary suffering upon animals is wrong. Many fewer people, including among ethicists, agree that painlessly killing animals is necessarily wrong. The most commonly cited reason is that death (without pain, fear, distress) is not bad for them in a way that matters morally, or not as significantly as it does for persons, who are self-conscious, make long-term plans and have preferences about their own future. Animals, at least those that are not persons, lack a morally (...) significant interest in continuing to live. At the same time, some argue that existence itself can be good, insofar as one’s life is worth living. For animals, a good life can offset a quick, if early, death. So, it seems to follow that breeding happy animals that will be (prematurely) killed can be a good thing overall. Insofar as slaughter and sale makes it economically sustainable to raise new ones, who would otherwise not exist, raising and killing animals for food who will have lives worth living is good overall. It benefits them as well as consumers, and makes the world better by adding to the sum of happiness. The process of raising and killing animals with positive welfare produces a sequence of replacement that maintains or increases overall welfare, all else being equal (assuming in particular no overall negative impact on the welfare of other parties). Call this the Replaceability Argument (RA) and the ensuing controversy the Replaceability Problem (RP). This is a problem at the crossroads of the ethics of killing, agricultural ethics, procreation ethics, and population ethics. (shrink)

I argue for the Cooperative Warrant Thesis (CWT), according to which the determinants of testimonial contents in communication are given by the practical requirements of cooperative action. This thesis distances itself from conventionalist views, according to which testimony must be strictly bounded by conventions of speech. CWT proves explanatorily better than conventionalism on several accounts. It offers a principled and accurate criterion to distinguish between testimonial and non-testimonial communication. In being goal-sensitive, this criterion captures the role of weak and robust (...) cooperation in determining the contents to which speakers testify or fail to testify. And, finally, it yields a principled explanation of why testimony entails the epistemic commitments that distinguish it as an epistemic source. (shrink)

This paper provides an interpretation of Aristotle’s criticism to the solution to Meno’s Paradox suggested by Plato. According to Aristotle, when Plato says that reminiscence (anámnēsis) is achieved, what is actually achieved is induction (epagōgê). Our interpretation is based on two aspects: (1) semantic criticism, since Plato’s use of the term anámnēsis is unusual; and (2) the theory is not able to give an adequate explanation of the effective discovery.

In a world that is overflowing with journals and other outlets for scientific publication, the appearance of any new periodical requires some justification. There are already more journals than we can read and more conferences than we can attend. In the case of applied Ontology, we believe that the creation of anew journal not only is completely justifiable, it is downright exciting. For too long, workers in computer science have assumed that content comes for free. “Theory” in computer science has (...) always meant the theory of processes and of computation. We measure the complexity of computer programs in terms of how long it takes machines to execute them, not in terms of how long it takes people to understand and to represent the data on which those programs might operate. We typically describe computer code in terms of algorithms that operate on formal parameters, often without pausing to discuss where the data that might satisfy those parameters come from. This journal was founded on the premise that workers in computer science, informatics, and information science are overdue in paying as much attention to contents as they do to algorithms. (shrink)

Can we reify the form of a substance? Is it possible to identify DNA as the principle of our personal and numerical identity? These questions will be studied through Berti’s reading of Aristotle’s hylomorphism. Indeed, Enrico Berti proposes the identification of the DNA to the Aristotelian notion of form, thesis which raises many questions from an exegetical point of view and a metaphysical perspective. We will present the sources of Berti’s reading and one of the main objections made by Aristotle. (...) Thus, different versions of the Berti’s thesis will be examined and then, a thought experiment that makes them false. Finally, it will be proposed an aristotelian solution, coming from a contemporary Aristotelian (E. J. Lowe), that seems to prevent Berti’s mistakes and gives us a robust metaphysics of the identity. Despite intensive exegetical work, Plato’s description of dialectic in the Sophist still raises many questions. Through a close reading of this passage that contextualizes it in the general organisation of the Sophist, this paper provides answers to these questions. After presenting the difficult text, I contend that the “vowel-kinds” are necessary conditions for the blending of kinds. Then, I interpret the “cause of divisions” mentioned by the Stranger as the kinds responsible of the dichotomous division in the first half of (...) the dialogue. In the next part, I show that 235d5-e2 does not describe a procedure of “meta-divison” as some commentators have it, but that it describes the method of division itself. Finally, I connect the difficulty and the obscurity of the passage to the fact that dialectic is the supreme science and I explain why dialectic is the science of free men. (shrink)

Intellectual progress involves forming a more accurate picture of the world. But it also figuring out which concepts to use for theorizing about the world. Bayesian epistemology has had much to say about the former aspect of our cognitive lives, but little if at all about the latter. I outline a framework for formulating questions about conceptual change in a broadly Bayesian framework. By enriching the resources of Epistemic Utility Theory with a more expansive conception of epistemic value, I offer (...) a picture of our cognitive economy on which adopting new conceptual tools can sometimes be epistemically rational.
